Terms of Service

1. Acceptance and eligibility

By accessing or using MomyLand, you agree to these Terms and the Privacy Policy. You must be at least 18 years old and legally able to enter a binding agreement. If you do not agree, do not use the service.

2. Prototype status

Features, content, pricing, professional profiles, availability, account flows, and responses are demonstration material and may be incomplete, simulated, unavailable, or removed without notice. Do not rely on the prototype to preserve information, create an account, complete a purchase, book an appointment, or provide continuous access.

3. Wellness information only

MomyLand provides general educational, reflective, and wellness-oriented content. It does not provide medical, psychological, psychiatric, nutritional, legal, or other professional advice; diagnosis; treatment; prescriptions; or a provider-patient relationship. Content is not a substitute for a qualified professional who knows your circumstances.

Never disregard professional advice or delay seeking care because of content from MomyLand. Decisions about pregnancy, postpartum symptoms, mental health, medication, nutrition, or a child's wellbeing should be made with an appropriately qualified professional.

4. Emergencies and crisis situations

MomyLand is not an emergency service, does not monitor messages, and cannot guarantee that it will identify or respond to a crisis. If you or another person may be in immediate danger, contact local emergency services now. In the United States, call 911 or call or text 988. Do not use MomyLand as your only source of support.

5. Automated and simulated responses

Responses may be automated, generated, scripted, or simulated. They may be inaccurate, incomplete, repetitive, inappropriate, or not suited to your situation. You are responsible for evaluating content and obtaining professional review before acting on it. MomyLand does not promise any health, emotional, financial, or other outcome.

6. Professional and community features

Expert profiles, credentials, ratings, events, workshops, community spaces, and consultation records shown in the prototype are demonstration content. They are not endorsements or verification of a real person, license, availability, security standard, or service. Any future professional marketplace will require separate verification, booking, cancellation, payment, privacy, and professional terms.

7. Professional applications

Applying as a doctor or other professional does not guarantee review, verification, approval, listing, work, referrals, or an account. Applicants must provide truthful, current information and documents and authorize reasonable verification with licensing authorities, educational institutions, employers, professional registers, and screening providers where lawful. MomyLand may request more information, reject an application, suspend review, or revoke approval if information cannot be verified or raises safety, legal, credential, conduct, or platform-fit concerns.

An applicant must not submit patient information or records. Approval does not transfer responsibility for maintaining licenses, insurance, lawful scope of practice, professional standards, or required disclosures. Separate professional terms will apply before providing services through a production platform.

8. Accounts, subscriptions, and payments

The current registration and login interfaces do not create or authenticate a production account. Premium prices and subscription controls are previews, and the prototype does not process payment. Before any paid service launches, the applicable price, taxes, billing cycle, renewal, cancellation, refund rules, and payment provider will be presented for separate agreement.

9. Doctor workspace and patient communications

The doctor workspace is a demonstration and is not a secure clinical messaging system, electronic health record, telehealth platform, prescribing service, emergency channel, or substitute for systems required by professional or privacy law. Doctors and patients must not use it for emergencies, medical records, diagnoses, prescriptions, test results, treatment orders, or information that must be retained as part of a clinical record.

Doctors remain responsible for patient consent, identity verification, licensure, scope of practice, professional documentation, response times, continuity of care, emergency procedures, record retention, and use of compliant communication and telehealth systems. Courses and workshops must remain within the doctor's verified scope and clearly distinguish general education from individualized advice.

10. Your content and privacy

You retain ownership of content you enter. If a future service transmits content to MomyLand, you grant us a limited, worldwide license to host, process, reproduce, and display it only as needed to operate, secure, improve, and comply with law for that service. The current prototype's browser storage is described in the Privacy Policy.

Do not submit unlawful content, another person's confidential information, medical records, or identifying information about a child. MomyLand is not a confidential health-care provider, lawyer, or emergency responder.

11. Acceptable use

You may not:

• use the service for unlawful, harmful, fraudulent, abusive, or exploitative activity;
• attempt to access systems, accounts, or data without authorization;
• introduce malware, overload the service, scrape it at disruptive scale, or bypass safeguards;
• impersonate another person or misrepresent credentials or affiliation;
• use outputs to make high-impact medical or safety decisions about another person; or
• copy, resell, or exploit the service except as allowed by law or written permission.

12. Intellectual property and feedback

The MomyLand name, design, software, and original content are owned by the operator or applicable licensors and are protected by law. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the prototype for personal evaluation. Feedback may be used without restriction or compensation, but we will not claim ownership of your pre-existing intellectual property.

13. Third-party services

The service may display third-party links, images, tools, or services. MomyLand does not control or endorse them and is not responsible for their content, availability, security, or data practices. Your use of a third party is governed by its own terms.

14. Suspension and changes

We may change, limit, suspend, or discontinue any part of the prototype at any time. We may restrict access if reasonably necessary to protect users, the service, third parties, or legal compliance. You may stop using the service at any time.

15. Disclaimers

To the fullest extent permitted by law, MomyLand is provided “as is” and “as available,” without warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, confidentiality, security, or any particular result. Some jurisdictions do not allow certain warranty exclusions, so those exclusions apply only to the extent allowed.

16. Limitation of liability

To the fullest extent permitted by law, the operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the service. The aggregate liability for all claims relating to the service will not exceed the greater of USD $100 or the amount you paid MomyLand in the 12 months before the event giving rise to the claim.

These limits do not exclude liability that cannot lawfully be excluded, including liability for fraud, intentional misconduct, or other non-waivable rights.

17. Indemnity

To the extent permitted by law, you agree to defend and indemnify the operator from third-party claims caused by your unlawful use, your content, or your material violation of these Terms. This section does not apply where prohibited by consumer law.

18. Disputes and applicable law

Before filing a claim, you and the operator agree to try in good faith for 30 days to resolve it by written notice, unless urgent relief is needed. Governing law and venue will be determined under applicable conflict-of-law and mandatory consumer-protection rules until the operator's legal domicile is published. Nothing in these Terms removes rights that cannot be waived.

19. General terms

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not transfer these Terms without consent; the operator may transfer them as part of forming an entity, financing, merger, sale, or reorganization, subject to applicable law. These Terms and the linked policies are the entire agreement regarding the prototype.

20. Changes and contact

We may update these Terms. Material changes should be presented before they take effect for continued use. Questions or legal notices may be sent to support@momyland.com. Before commercial launch, the operator's legal name, domicile, and service address must be added.
